The petitioner apprehends his arrest in Hajipur Town P.S. case No. 809 of 2016 under Section 308 and other Sections of the Indian Penal Code.
The petitioner, his mother and son are alleged to have abused the informant and on protest the petitioner is alleged to have assaulted the informant with Lathi on his head. The learned counsel for the petitioner submits that petitioner is own brother of the informant. The occurrence took place due to land dispute. The informant got one lacerated wound on his parietal region 2"x1/6" muscle deep. The injury appears to be superficial in nature. Other injuries are also superficial and the
Patna High Court Cr.Misc. No.14129 of 2017 (3) dt.30-06-2017 2/2 doctor opined the injuries to be simple in nature. Considering the facts that the occurrence took place between two own brothers and the injuries on the person of informant is simple in nature, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Town P.S.
