The petitioner is languishing in custody for the offence punishable under Section 379 of the Indian Penal Code. The FIR of the occurrence of theft is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused. The petitioner is in custody since 16.02.2019. Investigation of the case is already complete. Submission is that nothing has been recovered from the possession of the petitioner.

Learned counsel for the State opposed the prayer for the reason of criminal antecedent of the petitioner disclosed in paragraph-3 of the petition.

No.43711 of 2019(2) dt.16-07-2019 2/2 Considering the facts that there is no material against the petitioner and investigation of the case is already closed, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Motihari Town P.S. Case No.298 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
