2. This is the 3rd attempt of the petitioner. Earlier the bail application of the petitioner was rejected twice vide order dated 02.08.2023 passed in Cr. Misc. No. 47840 of 2023 and vide order dated 21.06.2024 passed in Cr. Misc. No. 34319 of 2024.
3. The petitioner seeks regular bail in a case registered for the offence under Sections 341, 323, 326, 307, 504/34 of the Indian Penal Code. Later on Section 302 of the IPC was added.
4. The petitioner is accused of burning a woman and is in custody since 09.05.2023.
5. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.44831 of 2025(2) dt.01-08-2025 2/3 though the charges have been framed on 10.10.2023 but no witness has been examined till date. He further submits that similarly three co-accused persons have been granted bail by this Court.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. I have heard and considered the submissions of the parties. So far as the grant of bail to similarly situated coaccused persons namely Mahesh Mahto and Rajendra Mahto is concerned, their cases are distinguishable from that of the petitioner but considering the period of custody and the delay in trial, this application for regular bail is allowed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Addl. Sessions Judge, Saran at Chapra/concerned Court below in connection with Taraiya P.S. Case No. 44 of 2016 subject to conditions that:- (i). The petitioner will mark his attendance at the Taraiya Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
(ii) The petitioner shall appear in
Patna High Court CR. MISC. No.44831 of 2025(2) dt.01-08-2025 3/3 the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
(iii). Both the bailors will be blood relatives of the petitioner.
