For the Petitioner/s : Mr. DHARMENDRA KUMAR PASWAN For the Respondent/s : Mr. ANJANI KR SHARAN SC9 =========================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH And HON'BLE MR JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT (Per: HONOURABLE MR JUSTICE NAVANITI PRASAD SINGH) Date: 20-05-2015 A show cause has been filed by the Director General of Police (for brevity, the DGP) himself which has elaborately given details of steps taken at State level to monitor such cases of disappearance, kidnapping, ransom demand and missing of juveniles. 2 From the report, we can only notice that except for a few districts, other districts are not submitting reports as sought for by
Patna High Court MJC No.3150 of 2012 dt.20-05-2015 the DGP. It is a matter of concern and it is for the DGP to look into such cases and take appropriate decisions.
3 So far as present case is concerned, it is over five years that the minor daughter of petitioner is alleged to be missing. We find that even if she was minor at that time, she would be major by now and the allegation is that a neighbour arranged her elopement. Police and the law are taking their own course. It would be improper for us to interfere at this stage of investigation. 4 However, we would request the learned DGP to look into this case and bring it to a logical end. If the girl had eloped, she must be traced, her statement recorded and logical steps in accordance with law be taken. It would be a matter of concern if she was actually kidnapped for being not known where she might be? It is for the police to trace her out and bring the case to a logical end. The case is pending for over five years and cannot go on indefinitely. 5 With these observations and directions, this MJC, alongwith all IAs filed therein, are disposed of. 6 Let a copy of this order be sent to the DGP.
