The petitioner apprehends his arrest in connection with Koilwar P.S. Case No. 09/2021 registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and Sections 25(1-b)a,/26/35/27 of the Arms Act.

It has been submitted by learned counsel for the petitioner that the petitioner has been made accused only because he is the owner of the land from where the illegal mining is being alleged. The petitioner has clean criminal

Considering the facts and circumstances of the case and also the fact that petitioner bears clean antecedent, the present anticipatory bail application is allowed. Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Koilwar P.S. Case No. 09/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
