JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-07-2015 Learned counsel for the petitioner is permitted to make necessary correction in the nomenclature of respondent No.4. The petitioner seeks quashing of notice dated 6.8.2012 issued by the Executive Officer, Nagar Parishad, Nawada by which it has been directed to the petitioner's father to vacate the Stall No.13.
The petitioner submits that Stall No.13 at Station Road, Nawada was allotted to the petitioner's father Awadhesh Prasad Verma for a lease period of 15 years which expired on 30.11.2011. Unfortunately, the petitioner's father died on 31.10.2009. The
Patna High Court CWJC No.16530 of 2012 (2) dt.20-07-2015 petitioner being the son of Awadhesh Prasad Verma made various representations to the S.D.O., Sadar, Nawada for re-settlement of Stall No.13 in his favour. The petitioner states that even the amount spent by his father for construction of Stall No.13 has not been adjusted against the rent which later was obliged to do so. In my view, if the petitioner files a fresh representation seeking his grievance before the Executive Officer, Nagar Parishad, Nawada, he would consider the same within a period of two months from the date of its filing.
With the aforesaid observations and directions, this writ application stands disposed of.
