2. Petitioner seeks regular bail in connection with PS Case No. 474 of 2016 in a case registered for the offences punishable under Sections 147, 148 , 149, 302 and 307 of the Indian Penal Code and 27 of Arms Act.

3 . As per prosecution case , informant alleges that on the alleged date and time of occurrence , this petitioner along with other co-accused persons armed with rifles, pistols, and bombs surrounded house of cousin brother of the informant and co-accused Jagdambi Panjiyara shot the cousin of the informant

Patna High Court CR. MISC. No.49223 of 2025(2) dt.29-08-2025 2/3 who died at the spot and co-accused Jubli Panjiyara fired upon informant which hit the right hand of informant due to which he sustained two bullet injuries. It is further alleged that other coccused persons also made indiscriminate firing and subsequently, the present F.I.R. has been lodged.

4. Learned counsel for the petitioner submits that specific accusation of causing fire arm injury is against coaccused persons namely Jagdambi Panjiyara and Jubli Panjiyara . So far as, this petitioner is concerned, he is not alleged to have fired. Petitioner claims clean antecedent. Petitioner is in custody since 07.04.2025 . Chargesheet has already been submitted. It is further submitted that aforesaid co-accused Julmi Panjiyar against whom there is specific accusation has already been granted bail vide order dated 11.10.2018 passed in Cr. Misc. No. 61943 of 2018 .

5 . Learned A.P.P. for the State vehemently opposes the bail application .

6. Considering the aforesaid facts, period of custody and circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and
