JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Mahakar P.S. Case No. 92 of 2016b registered for the offence punishable under sections 406, 419, 409 and 420 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner was posted as Branch Manager at the relevant time. On the basis of papers submitted and forwarded by other employees of the Bank, petitioner sanctioned the loan. Cashier of the Bank has paid the amount to the persons without permission of this petitioner. There is no irregularity on his part. With regard to this a departmental proceeding was initiated by the Bank in which petitioner filed detailed reply and on consideration of the same the departmental proceeding has been dropped. Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Mahakar P.S. Case No. 92 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
