Petitioner apprehends his arrest in Nadi (supaul) P.S. case no. 7 of 2017 instituted for the offence under Section(s) 147,148,149, 323, 324, 307, 337, 341, 379 ,504 and 506 of the Indian Penal Code.

As per written report, there is allegation against accused persons including this petitioner of assaulting the brother of informant by means of Dabiya with an intention to kill. The case diary has been received. The injury report of the brother of informant is available in the case diary which is annexed as Annexure-3 to the bail petition which shows that he sustained two grievous injury caused by hard and blunt substance. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
