JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 01-07-2017 Heard Mr. Jha in support of the application seeking anticipatory bail in Katra P.S. Case No. 75 of 2016 registered under sections 465,467,468,471 and 420 IPC.

No one appears on behalf of the State.

The petitioner got employed as Panchayat Teacher in 2006. The authority found her roll number not indicated in the Gananpanjee maintained by Kameshwar Singh Sanskrit University, Darbhanga.

It is stated, referring to Annexure-4, that she has already filed an application for re-appraisal of the matter as it is not a case that the roll number assigned to her was in fact allotted to different person. Referring to Annexure 5 and 6, it is submitted that considering the above two benches of this Court have granted

Patna High Court Cr.Misc. No.20645 of 2017 (3) dt.01-07-2017 2/2 the privilege of anticipatory bail to other accused persons. It is further submitted that for obtaining the privilege of anticipatory bail, the petitioner is ready and willing to deposit the salary she received for five months in the office of the BEO of the concerned district or the superior officer thereto. Considering the above, the petitioner, Rinku Kumari, in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Shri S.K. Manjhi learned Judicial Magistrate 1st Class, Muzaffarpur in Katra P.S. Case No. 75 of 2016 on conditions that one of the bailors shall be her own/close family member. Along with the bail bonds, the petitioner shall produce the receipt/paper showing deposit/payment of the sum equal to five months salary she received from the government as indicated above. The deposit so made shall be without prejudice to her right, contention and defence in the case.
