Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 379 of the Indian Penal Code, registered in connection with Nawada P.S.Case No. 529 of 2021 (GR.No.2850 of 2021).

As per allegation, some unknown thieves stolen away the motor-cycle of the informant from his house. The learned counsel for the petitioner has submitted that the petitioner is innocent. He did not commit any offence. His name has figured in the confessional statement of co-

Patna High Court CR. MISC. No.56210 of 2021(2) dt.28-06-2022 2/2 accused Narad Yadav which has no value in the eye of law. The petitioner, as per the submission is the person of clean antecedents.

Considering the above facts and circumstances, specially the clean antecedents of the petitioner, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S.Case No. 529 of 2021 (G.R.No. 2850 of 2021), subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
