JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2015 Petitioner is languishing in custody since 24.05.2014 in a case registered for the offences punishable under Sections 302/34 of the I.P.C.

It is alleged that five accused persons including the petitioner accompanied the husband of the informant to Sarpanch house for some reconciliation.

Subsequently the dead body of the husband of the informant was recovered. The suspicion was raised against the petitioner since petitioner and others were pressurizing to withdraw the earlier case lodged by the husband of the informant. It is submitted by learned counsel for the petitioner that there is no direct evidence against the petitioner and it is a case of only circumstantial evidence. This contention of the learned counsel for the petitioner has not been controverted by learned A.P.P after going through the case diary.

Patna High Court Cr.Misc. No.36524 of 2014 (4) dt.02-02-2015 2/2 Considering the circumstantial nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria Mufassil P.S. Case No. 558 of 2013.
