JUSTICE ARVIND SRIVASTAVA ORAL ORDER 25-08-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Motihari Muffasil P.S. Case No. 250 of 2017 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsels appearing for the petitioners submits that the present first information report has been lodged after delay of about one week without any explanation. There is case and counter case. Injuries have been found to be simple in nature. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the
Patna High Court Cr.Misc. No.31976 of 2017(4) dt.25-08-2017 2/2 petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in connection with Motihari Muffasil P.S. Case No. 250 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
