Petitioner apprehends his arrest in connection with Udwant Nagar P.S.Case No. 381 of 2017 registered for the offences punishable under Sections 341, 323, 307, 504, 34 of the Indian Penal Code and later on Section 302 IPC was added and 27 of the Arms Act.

Allegation against the petitioner is that he caught hold the deceased and his son fired at him.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted which will appear from the fact that while he was catching hold the deceased, his wife had gone to house and came back with pistol and thereafter firing was made, as such the aforesaid story does not look probable.

Having heard both sides and in the facts and circumstances, this is not a fit case for grant of anticipatory bail, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit.
