1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Khaira PS Case No. 287 of 2017 dated 29.11.2017 registered under Sections 341, 323, 498A, 494, 379, 34 of the IPC.

3. As per the first information report the informant has alleged that her marriage was solemnized with one Ritesh Singh in the year 2009 and after marriage her husband along with other family members started demanding dowry and due to non fulfillment of demand she was tortured mentally as well as physically by them.

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR and his name has been dragged during the course of investigation. The petitioner is

Patna High Court CR. MISC. No.46357 of 2023(2) dt.04-08-2023 2/2 uncle of husband of the informant and the husband of the informant has been granted anticipatory bail by a Co-ordinate Bench of this court in Cr. Misc. No. 27126 / 2018.

5. Regard being had to the submission made by the parties, taking into consideration the fact that petitioner is not named in the FIR and the husband of the informant has already been granted anticipatory bail by a Co-ordinate Bench of this court, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. X, Saran at Chapra in connection with Khaira PS Case No. 287 / 2017 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
