JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Gaighat P.S. Case No. 80 of 2019 for the offenses under Sections 394/34 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has not been named in the FIR. He is in custody since 29.3.2019 yet he has not been put on Test Identification Parade and charge sheet was submitted on 25.5.2019.

Considering the fact that the petitioner has neither been named in the FIR nor put on Test Identification Parade, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the
