Petitioner seeks modification of order dated 03.03.2016, passed in Cr. Misc. No. 40788 of 2015 by which anticipatory bail was granted to the petitioner in the event of his arrest or surrender within a period of eight weeks from the date of the order.

It has been submitted by the learned counsel for the petitioner that two days after grant of bail i.e. on 05.03.2016 he was forcibly arrested in Udwantnagar P.S. Case No. 128/16 and has been released on bail in that case on 10.11.2016, but could not file a modification petition earlier due to some political rivalry in the village.

Patna High Court Cr.Misc. No.31545 of 2017 (2) dt.12-07-2017 2/2 Considering the submission made by the learned counsel for the petitioner, period of surrender in connection with Udwantnagar P.S. Case No. 33/09, pending in the court of learned Chief Judicial Magistrate, Bhojpur at Ara, is extended for a further period of eight weeks from today.

Modification application is allowed to the extent indicated above.
