JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Bakhari P.S. Case No. 197 of 2016 for the offences punishable under sections 354, 509 and 506 of the I.P.C and section 8 of the POCSO Act. Allegedly, the petitioner used to tease the informant and other girls and on 05.10.2016 in the evening when the informant and others were returning from tuition the petitioner pulled the scarf of the informant.
Submission is of false implication and that now due to intervention of the well wishers and friends the matter has been compromised, the compromise petition has already been filed in
Patna High Court Cr.Misc. No.19477 of 2017 (3) dt.01-07-2017 2/2 the court of A.D.J-I, Begusarai in Bakhari P.S. Case No. 197 of 2016/ POCSO Case No. 65 of 2016, certified copy of the compromise petition is being filed today, the said certified copy is taken on the record, and as such the petitioner deserves sympathetic consideration.
The learned A.P.P. submits that now the case has been compromised.
In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.S.J- Cum- Special Court POCSO, DistrictBegusarai in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
