This application for anticipatory bail arises out of Ghosi P.S. Case No. 89 of 2019, disclosing offences under Sections 147, 148, 323, 324, 307 and 504 of the Indian Penal Code.
There is allegation in the FIR that the petitioners assaulted the informant with iron rod and Lathi. They also assaulted the informant's son, who had come to his rescue. Learned counsel for the petitioners contends that the present FIR is a counterblast to an FIR, being Ghosi P.S. Case
Patna High Court CR. MISC. No.43928 of 2019(2) dt.17-07-2019 2/2 No. 53 of 2019, registered much earlier by the father of petitioner nos. 1, 2 and 3. It has also been argued that there is no report of any serious injury caused on the body of the prosecution side.
Considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned ACJM-1, Jehanabad in connection with Ghosi P.S. Case No. 89 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
