JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Complaint case no. 1160 C of 2013, registered for the offence under Section 365 of the Indian Penal Code.

It appears that earlier also a complaint case, bearing Complaint case no. 30 C of 2011, was filed by the present complainant before the court, which gave rise to Parbatta P.S. case no. 16 of 2011, in which final form was submitted against the petitioner.

Learned counsel submits that there is a title suit pending between the parties since 2011.

In the facts and circumstances of the case, in the

No.17112 of 2017 (3) dt.01-07-2017 2/2 event of arrest or surrender before the court below within four weeks from today petitioner, above named, be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Khagaria in connection with Complaint case no. 1160 C of 2013 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
