JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-07-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Pupari P.S. Case No. 50 of 2017 for the offences punishable under sections 341, 323, 342, 307, 504 and 506/34 of the I.P.C.

Allegedly, the petitioner Kusami Devi assaulted with lathi on the foot of the informant and the petitioner Sheela Kumari assaulted with butt of Khurpi on the back and left foot and the petitioner Bechan Ram pulled the informant after roping Gamchha in her neck.

Submission is of false implication and that no injuries

Patna High Court Cr.Misc. No.19190 of 2017 (3) dt.01-07-2017 2/2 have been found on the vital part of body of the informant, no offence under section 307 of the I.P.C. is made out, without any fault the petitioners have been implicated in this case, all the allegations are baseless and concocted and as such the petitioners deserve sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners.

In the facts and circumstances as stated above, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. S.D.J.M. Pupari at Sitamarhi in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
