JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-06-2023 The present petition has been filed to renew the prayer for grant of bail to the petitioner which was earlier rejected vide order dated 26.03.2021 passed in Cr. Misc. No. 38441 of 2020.
It appears that vide order dated 12.05.2023, an explanation was called for from the Senior Superintendent of Police, Patna as to why the remaining witnesses were not produced before the learned Court below for their examinations despite the specific order of this Court to conclude the trial within nine months. In pursuance to the direction of this Court, a counter affidavit has been filed on behalf of Senior
Patna High Court CR. MISC. No.46289 of 2022(8) dt.20-06-2023 2/2 Superintendent of Police, Patna where he tendered his unqualified and unconditional apology for the inconveniences caused to this Court and submitted that remaining witnesses shall be produced before the learned Trial Court expeditiously, preferably within two months.
In that view of the matter, the petition is disposed off with a direction to the learned Court below to conclude the trial within a period of four months. The petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within a period of four months.
