The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 307, 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The petitioners are father-in-law, mother-in-law and brother-in-law (Bhaisur) of the informant Roshni Kumari. It appears that earlier a complaint case was filed, which gave rise to the present police case.

As per prosecution case, the father-in-law and mother-in-law caught the informant, whereupon her husband tried to set her on fire. However, as she raised halla, the neighbours

Learned counsel submits that the allegation of setting fire is against the husband of the informant. Furthermore, there is no evidence that the informant has sustained any burnt injury. In the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today petitioners, above named, be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Madhubani in connection with Madhubani Mahila P.S. Case no. 91 of 2016 subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Samarendra Pratap Singh, J.) Uday/- U T
