The petitioner apprehends his arrest in connection with Jandaha P.S. Case No. 78 of 2009, registered under Section 392 of the Indian Penal Code, pending in the court of the Addl. Chief Judicial Magistrate-IV, Vaishali at Hajipur. Learned counsel appearing for the petitioner submits that, in fact, the petitioner used to reside at Ludhiana in connection with his livelihood and he had no knowledge about lodging of Jandaha P.S. Case No. 78 of 2009, registered under Section 392 of the Indian Penal Code and also regarding submission of Chargesheet showing him absconder. Further submission is that, in fact, petitioner came to know about the said case in the month of January, 2018.
Patna High Court Cr.Misc. No.44079 of 2018(6) dt.13-02-2019 2/2 Having considered the facts and circumstances of the case and submission of Chargesheet against the petitioner showing him as absconder, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, his prayer for grant of prearrest bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
