2 It is submitted by the learned counsel for the petitioner that some of the grievances of the petitioner have been redressed. Benefit on account of admitted MACP, leave encashment and gratuity have been paid to the petitioner. It is also submitted by the respondent-State that accordingly the pensionary dues of the petitioner have also been fixed. Petitioner's learned counsel disputes the benefits given under certain heads. He submits that some of the
Patna High Court CWJC No.5261 of 2015 dt.27-08-2018 2/2 benefits made available as per the decision of the authorities communicated in the counter affidavit are disputed. He submits that the petitioner is entitled to the Grade Pay of Rs 4,800/- and that his pension has also not been properly fixed. He submits that for these issues, he will submit a representation to respondent No 4. 3 If such representation is filed within a period of four weeks from today, respondent No 4 would be obliged to consider the same as per admissibility of the petitioner and pass a reasoned and speaking order in accordance with law within a period of eight weeks thereafter.
4 Writ petition is disposed of.
