JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw this bail petition, so far as petitioner no. 1 Noor Mohammad is concerned.
Accordingly, in respect of petitioner no. 1, this anticipatory bail petition is dismissed as withdrawn. Heard learned counsel for the parties.
The petitioners (i.e. petitioners no. 2, 3 & 4) apprehend their arrest in a case registered for the offence under Sections 323, 341, 307, 504, 506/34 of the Indian Penal Code. As per F.I.R., all the accused persons including these petitioners assaulted the informant and his brother with iron rod,
Patna High Court CR. MISC. No.46161 of 2022(2) dt.06-12-2022 2/2 as a result of which, both of them sustained injury. Doctor has found simple injury. It is further submitted that due to land dispute between the parties, a simple occurrence of Maarpit took place. Petitioners (petitioners 2 to 4) claim clean antecedent.
Learned counsel for the informant vehemently opposed the prayer for bail.
Considering the nature of allegation and clean antecedent, let the above named petitioners no. 2, 3 and 4, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Begusarai / concerned court in connection with Matihani P.S. Case No. 20 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. This application is, accordingly, disposed of. (Prabhat Kumar Singh, J) anay/- U T
