2. The petitioner is in custody in connection with Hajipur Town P.S Case No. 23 of 2024 registered for the offences punishable under Sections 302 of the I.P.C & Section 27, 25(1-b)a of Arms Act.
3. As per First Information Report, unknown miscreants stopped the motorcycle of the brother of the informant and fired bullet on it.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that neither petitioner is named person nor
Patna High Court CR. MISC. No.44464 of 2025(3) dt.03-09-2025 2/3 he was seen by anyone at the alleged place of occurrence . It is also submitted that petitioner is in judicial custody since 23.12.2024.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order dated 07.04.2025, it appears that neither petitioner is named person in FIR nor he was seen by anyone at the alleged place of occurrence. No eye witness have stated the involvement of the petitioner in alleged occurrence.
7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Hajipur Town P.S Case No. 23 of 2024, subject to the following condition:- i) If similar nature of offence is reported against the petitioner in future, prosecution is at liberty to move for cancellation of his bail.
