JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 29-09-2015 The petitioners are aggrieved by the order dated 24.01.2012 passed in Appeal Case No.03 of 2011 by the respondent S.D.O., Katihar, as contained in Annexure-4, whereby the appeal preferred by the respondent no.6 against the order dated 08.06.2009 passed in Case No.04 of 2009-10 by the Anchal Adhikari, Hasanganj under Section 48D of the Bihar Tenancy Act, 1885 has been allowed and the order passed by the Anchal Adhikari has been set aside.
In the considered opinion of this Court against the order impugned, the petitioners have an alternative and efficacious remedy before the learned Bihar Land Tribunal, Patna in view of the provisions contained in Section 9 of the Bihar Land Tribunal
Patna High Court CWJC No.13018 of 2012 (3) dt.29-09-2015 Act, 2009.
In above view of the matter, the present writ petition is dismissed with a liberty to the petitioners to approach the learned Bihar Land Tribunal, Patna for grant of appropriate relief(s) with respect to the lands under dispute. (Birendra Prasad Verma, J) Arvind/- U
