This is a petition for grant of anticipatory bail for offence under Sections 448, 323, 307, 504, 506 and 354/34 of the Indian Penal Code.
family member of these petitioners was hospitalized in the nursing home of the informant. Allegation is that the petitioners misbehaved, abused with the informant and committed assault.
Submission of the learned counsel for the petitioners is that only altercation had taken placed due to non-attendance of the ailing patient.
Considering the nature of allegation, let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Katihar Town P.S. Case No. 399 of 2017 to the satisfaction of the Chief Judicial Magistrate, Katihar, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
