The petitioners apprehend their arrest in Simari P.S. Case No. 99/2016, instituted for the offences punishable under Sections 406, 407, 420, 421, 422, 423 and 120(B) of the Indian Penal Code.
It is alleged against the petitioners that they have embezzled money of different schemes of government. It is further alleged that petitioner no. 2 had taken passbook of Baijnath Pathak and withdrawn money for which complaint had been filed by Rekha Devi and Maho Devi on which basis Simri P.S. Case No. 193/2012 and 198/2012 were instituted.
The enquiry report, submitted by the Additional
Patna High Court Cr.Misc. No.41632 of 2018 (3) dt.13-08-2018 2/2 Collector, Establishment, is part of the F.I.R., which is available at running page 12-15. The detail of irregularities committed by this petitioner has been mentioned in enquiry report. The enquiry officer has found allegation of embezzlement of government money against the petitioners true. Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners is rejected.
