The petitioner apprehends his arrest in connection with Birpur P.S. Case No. 222 of 2021 registered under Section 307 and other allied sections of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Earlier, nephew of the petitioner has also lodged a counter case (Annexure-2 and 3) against the informant's side in which he got injured. Further he submits that from perusal of Annexure nos. 4, 5 and 8, it appears that there is land dispute between the parties. Brother of the petitioner has also filed petitions for threatening to the petitioner by opposite parties and also demanded extortion, as would be evident from
Patna High Court CR. MISC. No.55955 of 2021(2) dt.09-05-2022 2/2 Annexure nos. 6 and 7. It is also submitted that petitioner is agnate of the informant and there are several land disputes between both the parties. Petitioner has no criminal antecedent Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M.-I, Birpur, Supaul in connection with Birpur P.S.
