1. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondent.

2. During the course of the argument, a preliminary objection was raised by the respondent's counsel asserting that the writ petition is not maintainable as the matter pertains to Company Law. The relief sought by the petitioner is related to directing the respondents to conduct an inquiry into significant financial defalcation and embezzlement of public funds by financial companies.

3. On perusal of the record, it is evident

Patna High Court CWJC No.2395 of 2016(3) dt.29-04-2025 2/2 that the writ petition is filed for directing the respondent to investigate the misuse of public funds. However, this is not a Public Interest Litigation (PIL), and as such, the writ petition is not maintainable.

4. At this juncture, the Learned counsel for the petitioner seeks permission to withdraw this writ petition, with the liberty to approach the appropriate forum.

5. Liberty is granted. The appropriate authority shall consider the limitation aspect as the petition was filed in the year 2016.

6. Accordingly, the writ petition is dismissed as withdrawn.
