01-07-2017 Heard Sri Sanjiv Kumar Singh, learned counsel for the petitioner and Sri Shyam Kumar Singh, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Kasim Bazar P.S. Case No. 178 of 2016 registered for offence under Section 30 of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that nothing was recovered from the possession of the petitioner, however; his name has come on the statement of two accused persons, who were apprehended alongwith 8 litres of Indian make foreign liquor. He submits that accused persons had disclosed that they were going to supply the said wine to the petitioner. Save and

Learned Addl. Public Prosecutor has opposed the prayer for grant of bail.
However, considering the nature of accusation, there is no reason to refuse the prayer for anticipatory bail. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Vicky Kumar & Vicky Kumar Sinha be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Kasim Bazar P.S. Case No. 178 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
