Petitioner apprehends his arrest in connection with Gogri P.S.Case No. 463 of 2017, G.R.No. 3113 of 2017, registered for the offences punishable under Sections 341, 323, 307 and 506/34 of the Indian Penal Code.

Allegation against the accused persons, including the petitioner is of assault to the informant.

Submission of learned counsel for the petitioner is that there is general and omnibus allegation of assault and only one injury was found on the person of informant.

Heard learned APP also, who has opposed the prayer for anticipatory bail stating that allegation of causing head injury is attributed against the petitioner, which is grievous in nature, as it appears from the case diary.

Patna High Court Cr.Misc. No.41563 of 2018 (3) dt.14-08-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit.
