JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-01-2023 Heard the learned counsel for the petitioner and the learned A.P.P. for the State. The petitioner seeks regular bail in connection with Khaira P.S. Case No. 146 of 2022 for the offence registered under Sections 302 and 34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein having killed the deceased victim lady whose marriage was solemnized with the petitioner in the year 2001.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case, is

The learned counsel for the petitioner has further submitted that it is unusual that the grand daughter of the informant aged about 2 years, would inform the informant on mobile that her mother has been killed and her dead body is lying in the house, hence it is apparent that the petitioner has been framed in the present case.

Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also considering the materials available in the case diary, this Court finds that there are ample materials to connect the petitioner with the alleged crime and even the supervising police authority has found the complicity of the petitioner in the alleged occurrence, apart from the fact that the witnesses

Patna High Court CR. MISC. No.45928 of 2022(3) dt.10-01-2023 3/3 examined by the police have supported the case of the prosecution, hence, I do not find any merit in the present petition.

Accordingly, the present petition stands dismissed.
