====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 04-09-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner is apprehending his arrest in Rajoun P.S. Case No.564 of 2017 for the offences registered under Section 302/34 of the Indian Penal Code.

Informant who is the mother of deceased has stated in her written complaint that on 09.10.2017 at about 3:30 P.M. petitioner and co-accused Niraj Kumar were talking with deceased Puja Kumari and this information was given to the informant by his son and after information, when informant reached at her house, she saw that her daughter was hung with her dupatta. It is further alleged that the informant suspects that petitioner and co-accused have committed murder of her daughter.

Patna High Court Cr.Misc. No.44279 of 2018(3) dt.04-09-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has not committed any offence. He has been implicated in this case due to land dispute with his family. He has no criminal antecedent.

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka in connection with Rajoun P.S. Case No. 564 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
