JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Pachrukhi P.S. Case No. 301 of 2015 registered for the offence punishable under sections 302, 201 and 120B of the Indian Penal Code. Vide order dated 13.07.2017 after detailed consideration case diary was called for and the matter was directed to be listed on receipt of the case diary. In the meantime, petitioner was granted interim protection.

Learned counsel appearing for the petitioner submits that petitioner is neither named in the first information report nor has been named in the first two charge sheets submitted by the police. Petitioner has been implicated in this case on basis of confessional statement of the co-accused. Except suspicion raised by some witnesses, nothing has come against this

Patna High Court Cr.Misc. No.31304 of 2017(5) dt.08-09-2017 2/2 petitioner to suggest his complicity in the alleged crime. Moreover, petitioner is a public figure and there is no chance of his absconding.

Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Siwan in connection with Pachkrukhi P.S. Case No. 301 of 2015 subject to the conditions laid down under section 438(2) Cr.P.C.
