The petitioner apprehends his arrest in connection with Revilganj P.S. Case No. 93 of 2017 registered under Section 366A/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the statement of the victim under section 161 Cr. P.C. has not been recorded. The victim, in her statement recorded under section 164 Cr. P.C., has given the different version. Further submission is that on perusal of Annexure-3 to the supplementary affidavit, it appears that the victim and present petitioner have already married each other in temple and started living as husband and wife and both sworn an affidavit to that effect. Further
Patna High Court Cr.Misc. No.34998 of 2017 (6) dt.08-11-2017 2/2 submission is that both are major.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VIII, Chapra in connection with Revilganj P.S. Case No. 93 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
