2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 143 (5) of the BNS and Section 79 of the Juvenile Justice Act.
3. The case of the prosecution is that on suspicion, certain children engaged in child labour were taken out from a train at Bhabua Railway Station with the assistance of railway officers and constables for necessary enquiry. It is alleged that along with the present petitioner, four minor boys were apprehended.
4. Learned counsel for the petitioner submits that the boys were following the petitioner of their own free will. From a perusal of the case diary, it is clear that Laldev Bharti and two
Patna High Court CR. MISC. No.45944 of 2025(3) dt.11-09-2025 2/2 other witnesses have stated that the boys were accompanying the petitioner voluntarily and not under any compulsion.
5. Learned APP appearing on behalf of the State has fairly conceded the submissions of the learned counsel for the petitioner and supported the contention put forward by the learned counsel for the petitioner.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bhabhua Rail P.S. Case No. 12 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Railway Court, Gaya.
