Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, office will place the matter before the Bench. This restoration application has been filed for restoring Cr. Misc. No.53179 of 2021 to its original file. Finding the ground taken by the petitioner in this restoration application sufficient for restoring the aforesaid application and in the interest of justice, this restoration application is, accordingly, allowed and Cr. Misc. No.53179 of 2021 is restored to its original file.

It is submitted by learned counsel for the petitioner that

Patna High Court CR. MISC. No.42908 of 2022(2) dt.17-08-2022 2/2 he has already filed requisites etc. for issuance of notice upon the respondent no.2 on 30.05.2022.

Considering the same, office is directed to issue notice upon the respondent no.2 using the requisites etc. filed by counsel for the petitioner on 30.05.2022.
