The petitioner is languishing in custody for the offences punishable under Sections 419/420/465/468/471 of the Indian Penal Code and Section 15(3) of the Indian Medical Council Act, 1956.

Allegation against the petitioner is that though he is not a dentist. However, is involved in the treatment of patient as B.D.S.

Learned counsel for the petitioner submits that Annexure-2 is the certificate of Diploma in Dental Science in favour of the petitioner granted by Bihar State Dental Council. There is no material that the petitioner has performed surgery

Patna High Court CR. MISC. No.44512 of 2019(2) dt.19-07-2019 2/2 on anyone. The allegation maker is own nephew of the petitioner. Due to family dispute false allegation has been levelled.

Learned counsel for the informant opposed the prayer for bail.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Jakkanpur P.S. Case No.623 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr/kamlesh/- U T
