The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 36, 41(i)(ii) of Bihar Prohibition and Excise Act.

2131 liters of foreign liquor has been recovered from a truck.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the vehicle in question and has been made accused only on suspicion. Nothing has been recovered from the conscious possession of the petitioner. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got one criminal antecedent of similar nature.
