1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Shahpur P.S. Case No. 263 of 2023 dated 13.06.2023 registered for the offence(s) punishable under Section(s) 30(a) of the Bihar Prohibition and Excise Act.
3. The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to recovery of 100 litres of country made wine from the house of this petitioner but in actual the said house is in joint possession of the family members of this petitioner, petitioner has fair and clean antecedent and he has been languishing in jail since 14.06.2023 and the witnesses of the search and seizure are official persons and there is no independent person.

4. Learned APP appearing for the State has opposed the bail prayer.
5. Considering the above submissions and mainly petitioner's fair and clean antecedent and also his plea as to the place of recovery being in joint possession of his family members, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Shahpur P.S. Case No. 263 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
