====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 24-05-2021 Heard the parties in virtual Court.
The petitioner is languishing in custody for the offence punishable under Sections 20 and 22 of the N.D.P.S. Act.
More than 10 Kg of ganja was recovered from the possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.
Submission is that the case is not covered by Section 37 of the N.D.P.S. Act as recovered quantity is not commercial quantity. Petitioner is in custody since 16.06.2020. Investigation of the case is already complete.
Considering the facts aforesaid, let the petitioner, above named, be released on bail, after framing of the charges so that the trial may not hamper, on furnishing bail bond of
Patna High Court CR. MISC. No.2027 of 2021(3) dt.24-05-2021 2/2 Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Valmikinagar P.S. Case No. 21 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
