The present application has been filed for cancellation of anticipatory bail granted to the opposite party no. 02 and 03 by learned Additional Sessions Judge-X, Gaya vide order dated 03.01.2024 passed in ABP No. 3019 of 2023 arising out of Wazirganj P.S. Case No. 96 of 2021 registered for the offence under Sections 498-A/34 of the Indian Penal Code and under Sections 3/4 of the D.P. Act.

3. Learned counsel for the petitioner has not been able to make out a case for cancellation, however, he submits that a

Patna High Court CR. MISC. No.58469 of 2024(2) dt.27-07-2026 2/2 Maintenance Case is pending in the Court of Principal Judge, Family Court, Gaya but the same is not being disposed of. He also submits that the petitioner has no source of income.

4. In view of the above, this application is disposed of with a direction to the Principal Judge, Family Court, Gaya to conclude the proceedings of Maintenance Case within three months from the date of communication of a copy of this order by holding day to day hearing. He is also directed to proceed exparte against the non-cooperating party and will send a report to this Court after three months.

5. List this case after three months under the heading "For Orders" for perusal of the report of Principal Judge, Family Court, Gaya.

6. Let a copy of this order be communicated to the Principal District and Sessions Judge, Gaya through FAX for its compliance.
