The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 468, 471 and 120-B of the Indian Penal Code 3/4 of Bihar Examination Act. On 16.02.2017, the informant (Block Development Officer, Aurangabad) received informations that Samir Raj, a Teacher of Uttar Narayan Classes, circulated solved question of Intermediate examination, 2017 (Physics), on mobiles of the examinees. Thereafter, a team was constituted and Samir was intercepted. On query, Samir disclosed the involvement of six more persons, eg. Satish Kumar, Amarjeet Kumar, Jitendra Kumar, Ravi Ranjan @ Pramod (petitioner) and Bablu Kumar, in the episode.

Patna High Court Cr.Misc. No.21570 of 2017 (3) dt.01-07-2017 2/2 Learned counsel submits that the petitioner is a teacher of math and as such he apparently would not be involved in solving or messaging questions of Physics paper. He further submits that there is no mention that any such messages had been forwarded to the mobile of any of the examinees. He further submits that there is nothing in the case diary to connect the petitioner in the alleged connivance.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner, above named, be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Town P.S. Case no. 55 of 2017 subject to the conditions as laid down under Section 438 (2) Cr.P.C. with further condition that the petitioner would not physically absent for two consecutive dates at stretch, till charge is framed in the case, failing which his bail bonds would be cancelled.
