JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302, 201, 120(B) of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons, named in the FIR, in a planned manner committed the murder of brother of the informant Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that only suspicion has been raised agaisnt this petitioner due to previous enmity. No specific overt act has been attributed to this petitioner. During the course of investigation no tangible material has come against this petitioner to show his involvement in the aforesaid crime.

Patna High Court CR. MISC. No.55262 of 2021(2) dt.28-06-2022 2/2 Similarly situated accused Ravindra Yadav has already been granted bail by a co-ordinate Bench of this court vide order dated 26.04.2022 passed in Cr. Misc. No. 49375/2021. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory and submitted that during the course of investigation ample material has come against this petitioner to show his involvement in the alleged occurrence. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
