JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2017 The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code.
The informant alleged that the accused persons had assaulted the informant with lathi, causing injury on her head. Learned counsel submits that the doctor has opined that the injury is simple in nature, but dangerous. He further submits that compromise has been arrived at between the parties and to this effect a petition has also been filed. In my view, the petitioner would surrender before the court below (Chief Judicial Magistrate, Katihar) in connection with Rautara P.S. case no. 13 of 2017 within a period of four weeks from today and if the informant appears and accept the factum of compromise, the petitioner would be released on bail to
Patna High Court Cr.Misc. No.17369 of 2017 (3) dt.01-07-2017 2/2 the satisfaction of the court, who is in seisin of the case. With the aforesaid observation, this application stands disposed of.
