JUSTICE SATYAVRAT VERMA ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner and Shri Nitya Nand Tiwary, learned A.P.P. for the State. The petitioner seeks bail in connection with Rajnagar P.S. Case No. 126 of 2021 instituted for the offences under Sections 414 and 34 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 10.04.2021, charge-sheet has been submitted in the case and after institution of the present case he came to be remanded in an another case as such it is submitted that prior to institution of the present case, the petitioner was a person with clean antecedent.

Learned counsel for the petitioner submits that allegation is of recovery of a motorbike, three mobiles and Rs.

Patna High Court CR. MISC. No.56084 of 2021(2) dt.23-02-2022 2/2 6,500/- from the petitioner and as far as allegation of recovery of arms is concerned, that is from other co-accused persons. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 10.04.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Madhubani in connection with Rajnagar P.S. Case No. 126 of 2021.
