This is a petition for grant of anticipatory bail for offence under Section 498A, 323, 304 and 406/34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act. The petitioner is the husband of opposite party no. 2. There is allegation of demand of dowry and torture for the same. Submission of the learned counsel for the petitioner is that the petitioner has already filed a case for divorce on the ground of adultery against the complainant, hence, there is no scope of settlement of dispute.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.
The prayer for anticipatory bail is refused.
However, the prayer for regular bail of the petitioner shall be disposed off without being prejudiced of this order. (Birendra Kumar, J) SA/- U √ T √
